Glenn Hagele filed a frivolous lawsuit against Dr. Lauranell Burch on July 13, 2010, and then later dropped his complaint after Dr. Lauranell Burch filed an anti-SLAPP motion.  The judge then ordered Glenn Hagele to pay Dr. Lauranell Burch $29,982 in attorney fees for having filed a frivolous lawsuit against her.

Excerpts from rulings.

Defendant is awarded attorney fees and costs in the amount of $16,857. This is the total amount of fees incurred in presenting the SLAPP motion, but excludes fees associated with the demurrer and motion to quash.  It also does not include costs associated with the related motions.  Although permissible under Ketchum, the Court has not considered any enhancement to the lodestar figure as none was presented here.

The foregoing also does not encompass fees associated with the presentation of the motion for fees.  As noted in the record of the oral argument, any such request may be presented in a subsequent motion provided that the same is timely filed.  The foregoing also does not encompass any fees associated with any appellate proceedings, as any sucyh award must await the resolution of such proceedings.

TO ALL PARTIES AND THEIR ATTORNEYS OF RECORD

PLEASE TAKE NOTICE that this matter was noticed for hearing May 3, 2011 at 2:00 PM in Department 53 before the undersigned judge to hear Defendant Lauranell Burch's Motion For Additional Attorneys' Fees Under CCP 425 16(c) ("Motion for Additional Attorneys' Fees"), which was filed on April 4, 2011.  No opposition to the Motion for Additional Attorneys' Fees was filed, and no party called for a hearing following the entry of the Court's tentative order to grant the unopposed motion, which was entered on May 2, 2011.  Accordingly, IT IS HEREBY ORDERED, ADJUDGED, AND DECREED THAT

The unopposed Motion for Additional Attorneys' Fees is GRANTED. Plaintiff's failure to opposed the motion is deemed a concession of the merits.

Accordingly, the Court finds that the hourly rates and time spent are reasonable.  Moving Party and Defendant Lauranll Burch is awarded additioinal attorneys' fees from Plaintiff Glenn Hagele in the amount of $13,125.00
